Legal Notice 142 of 2020 Moratorium on Credit Facilities in Exceptional Circumstances Regulations, 2020 – 13.04.2020
This Legal Notice supports economically vulnerable persons who have been materially affected by the COVID-19 pandemic through a temporary moratorium on the capital and interest payable for a period of six months, which may be extended. This moratorium is applicable to all credit and financial institutions regarding credit facilities, but the borrower may still decide to continue to pay the relevant interest.
Eligibilty for the moratorium is as defined in the Directive issued by the Central Bank of Malta (https://www.centralbankmalta.org/file.aspx?f=92812) and applicants may apply until the 30th June 2020, which time-limit may be extended.
Credit or financial institutions failing to comply with the moratorium may be subject to an administrative penalty and measures by the Central Bank, which may be appealed in front of the Financial Services Tribunal.
Credit and financial institutions are obliged to collect specific information which identifies obligors and exposures eligible to the moratorium and where the moratorium was applied.
